BUSYTAP TERMS & CONDITIONS

Welcome to BusyTap.

These Terms & Conditions (“Terms”) govern your access to and use of the BusyTap website, application, platform and related services (“Platform”).

BusyTap operates a technology-enabled marketplace that connects customers seeking personal care services (“Customers”) with independent personal care professionals (“Professional Partners”).

By creating an account, accessing the Platform or making or accepting a booking through BusyTap, you agree to these Terms.

1. About BusyTap

BusyTap provides a digital marketplace that enables Customers to discover, book and pay for personal care services offered by Professional Partners.

Unless expressly stated otherwise, Professional Partners provide their services independently through the Platform.

BusyTap facilitates connections, bookings, payments and other marketplace functions but does not itself perform the personal care services offered by Professional Partners unless expressly identified otherwise.

2. Eligibility

You must have the legal capacity to enter into a binding agreement to create and use a BusyTap account.

Where a user is below the age required to independently enter into such transactions under applicable law, use of the Platform must be authorised and appropriately supervised by a parent or legal guardian.

You agree to provide accurate, current and complete information when creating or maintaining your account.

3. User Accounts

Certain BusyTap services require an account.

You are responsible for:

* Maintaining accurate account information;
* Keeping your login credentials confidential;
* Preventing unauthorised access to your account;
* All activities conducted through your account, subject to applicable law; and
* Informing BusyTap promptly if you believe your account has been compromised.

BusyTap may require identity or contact verification before providing certain Platform features.

4. Customer Bookings

Customers may use BusyTap to select available services, Professional Partners, locations, dates and times.

A typical booking process may include:

Pin Location → Choose Service → Make Payment → Confirm Booking

A booking is considered confirmed when the Platform displays confirmation or BusyTap otherwise communicates confirmation to the Customer.

Availability is not guaranteed until the booking has been successfully confirmed.

Customers are responsible for ensuring that booking information, including service location, contact information, date, time and selected service, is accurate.

5. Professional Partners

Professional Partners are responsible for maintaining accurate information regarding their:

* Services;
* Pricing;
* Availability;
* Service areas;
* Professional experience;
* Qualifications or certifications where applicable;
* Portfolio;
* Equipment; and
* Other information displayed through BusyTap.

Professional Partners must perform accepted services professionally, safely, hygienically and in accordance with applicable laws and requirements.

BusyTap may establish verification requirements before allowing a Professional Partner to offer services through the Platform.

Verification does not constitute a guarantee by BusyTap regarding the quality, suitability or outcome of every service.

6. Independent Professional Partners

Unless a separate written agreement states otherwise, Professional Partners use BusyTap as independent service providers.

Nothing in these Terms is intended by itself to create an employment, agency, partnership, joint venture or franchise relationship between BusyTap and a Professional Partner.

Professional Partners remain responsible for their own services and for complying with applicable professional, licensing, taxation and regulatory obligations.

The legal classification of any relationship remains subject to applicable Malaysian law regardless of terminology used in these Terms.

7. Prices and Platform Charges

Service prices displayed through BusyTap may be determined by BusyTap, Professional Partners, or a combination of platform rules and Professional Partner selections, depending on the service.

Before confirming a transaction, Customers should be shown the applicable price and relevant charges.

BusyTap may charge fees including:

* Service fees;
* Platform fees;
* Booking fees;
* Cancellation fees;
* Professional Partner commissions; and
* Other clearly disclosed charges.

Applicable fees may change from time to time.

Where required, applicable taxes will be charged in accordance with Malaysian law.

8. Payments

BusyTap may facilitate payments through third-party payment service providers.

Customers authorise the applicable payment to be processed when completing a transaction.

Professional Partner payouts may be subject to:

* BusyTap commissions;
* Platform fees;
* Refunds;
* Adjustments;
* Chargebacks;
* Promotional arrangements;
* Applicable taxes; and
* Other authorised deductions.

Payment processing may also be subject to the terms of the relevant payment provider.

9. Cancellations and Refunds

BusyTap may maintain a separate Cancellation & Refund Policy applicable to bookings.

Depending on the circumstances, cancellation charges may apply when a Customer cancels a confirmed booking, particularly where the Professional Partner has reserved time or has already travelled towards the service location.

If a Professional Partner cancels a confirmed booking, BusyTap may attempt to provide another available Professional Partner or process an appropriate refund where applicable.

Refund eligibility may depend on factors including:

* Timing of cancellation;
* Failure of a Professional Partner to attend;
* Duplicate or incorrect charges;
* Service disputes;
* Payment-provider requirements; and
* Applicable consumer protection law.

Any applicable cancellation fee should be disclosed before the Customer confirms a booking or otherwise made reasonably available through the Platform.

Nothing in these Terms limits rights that cannot lawfully be excluded under applicable consumer protection laws.

10. Late Arrival and No-Shows

Customers should be available at the confirmed location at the scheduled booking time.

Professional Partners should make reasonable efforts to arrive at the agreed time.

Where either party is delayed, they should communicate through the available BusyTap communication channels where possible.

Repeated no-shows, unreasonable delays or misuse of bookings may result in cancellation charges, restrictions or account action.

11. Service Locations

Customers are responsible for providing a location that is accurate, accessible and reasonably safe for the requested service.

Professional Partners may decline or discontinue a service where they reasonably believe that the environment creates a genuine safety risk, involves unlawful activity or prevents the service from being performed appropriately.

Customers must provide reasonable access to the agreed service location.

12. Customer Conduct

Customers must treat Professional Partners respectfully and must not:

* Harass, threaten or abuse a Professional Partner;
* Engage in discriminatory conduct;
* Request illegal or inappropriate services;
* Provide intentionally false booking information;
* Attempt fraudulent payments;
* Damage a Professional Partner’s equipment or property;
* Create unsafe working conditions; or
* Use BusyTap for unlawful purposes.

Serious violations may result in immediate account restriction or suspension.

13. Professional Partner Conduct

Professional Partners must:

* Treat Customers respectfully;
* Maintain appropriate hygiene and professional standards;
* Use suitable and properly maintained equipment;
* Provide only services they are reasonably qualified to perform;
* Respect Customer privacy;
* Protect Customer personal information;
* Avoid harassment, discrimination or inappropriate behaviour;
* Comply with applicable laws and regulations; and
* Accurately represent their services, experience and qualifications.

Professional Partners must not use Customer information obtained through BusyTap for unrelated purposes without appropriate authorisation.

14. Ratings and Reviews

Customers may be permitted to rate or review Professional Partners following completed services.

Reviews must reflect genuine experiences and must not contain unlawful, fraudulent, threatening, discriminatory, defamatory or otherwise prohibited content.

BusyTap may moderate or remove content where reasonably necessary to enforce Platform rules or applicable law.

BusyTap may also implement systems allowing Professional Partners to provide relevant feedback regarding Customer conduct.

15. Promotions and Discount Codes

BusyTap may offer promotional codes, referral programmes, discounts, credits or other promotional benefits.

Promotions may:

* Have expiry dates;
* Apply only to selected services or locations;
* Require minimum spending;
* Be limited to selected users;
* Be restricted to one use;
* Be non-transferable; or
* Be subject to additional promotional terms.

BusyTap may reject or withdraw promotional benefits obtained through fraud, manipulation or misuse, subject to applicable law.

16. Safety

Safety is a shared responsibility across the BusyTap marketplace.

Customers and Professional Partners should exercise reasonable care when meeting at private residences, offices, hotels or other locations.

Users should report serious safety concerns or inappropriate conduct to BusyTap.

Where there is an immediate threat to personal safety, users should contact the appropriate emergency or law-enforcement authorities.

17. Service Quality and Results

Personal care services may produce different results depending on the service, Professional Partner, Customer requirements and individual circumstances.

Customers should communicate their requested service and relevant requirements clearly before and during the appointment.

Where a Customer is dissatisfied with a service, they may contact BusyTap through the available support channels.

BusyTap may review complaints and facilitate communication or resolution between the Customer and Professional Partner where appropriate.

18. Platform Availability

BusyTap aims to provide a reliable Platform but does not guarantee that the Platform will always operate without interruptions, delays, technical errors or maintenance periods.

Certain features may depend on third-party services including internet connectivity, mapping services, communications infrastructure and payment providers.

BusyTap may modify, maintain, update or discontinue Platform features where reasonably necessary.

19. Intellectual Property

The BusyTap name, logo, Platform design, software, graphics, text, branding and other proprietary materials are owned by or licensed to BusyTap and are protected by applicable intellectual property laws.

Users may not reproduce, copy, modify, distribute, sell or commercially exploit BusyTap intellectual property without appropriate permission.

20. Privacy

Personal data collected through BusyTap will be handled in accordance with the BusyTap Privacy Policy and applicable Malaysian data protection requirements.

Users should review the Privacy Policy to understand how personal information may be collected, used, disclosed, retained and protected.

21. Prohibited Activities

Users must not:

* Create fraudulent accounts;
* Impersonate another person;
* Manipulate bookings, ratings or reviews;
* Use stolen or unauthorised payment methods;
* Attempt to bypass Platform security;
* Introduce malicious software;
* Scrape or extract Platform data without authorisation;
* Use BusyTap to facilitate illegal activity;
* Abuse promotional programmes; or
* Interfere with the proper operation of the Platform.

22. Off-Platform Transactions

BusyTap may prohibit or restrict Customers and Professional Partners from using the Platform primarily to identify one another and then intentionally bypassing BusyTap’s booking or payment system where such conduct violates applicable Platform rules.

Transactions completed outside BusyTap may not qualify for Platform-based support, payment records, dispute assistance or other protections offered for eligible BusyTap transactions.

23. Account Suspension and Termination

BusyTap may restrict, suspend or terminate access to the Platform where reasonably necessary, including where a user:

* Materially breaches these Terms;
* Engages in fraud;
* Creates safety risks;
* Misuses the Platform;
* Repeatedly fails to fulfil confirmed bookings;
* Violates applicable law; or
* Creates material risks to Customers, Professional Partners or BusyTap.

Where appropriate and legally required, BusyTap may provide notice or an opportunity to address the issue.

Users may also request closure of their account subject to outstanding transactions and applicable legal or record-retention requirements.

24. Complaints and Disputes

Customers and Professional Partners are encouraged to contact BusyTap support promptly regarding booking or service disputes.

BusyTap may review relevant information and attempt to facilitate a reasonable resolution.

Where a dispute cannot be resolved through BusyTap’s internal process, the parties retain any rights or remedies available under applicable Malaysian law.

25. Limitation of Liability

To the maximum extent permitted by applicable law, BusyTap’s liability may be limited in accordance with these Terms and applicable legal requirements.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Because services available through the marketplace may be performed by independent Professional Partners, responsibility for the actual performance of those services may rest with the relevant Professional Partner, subject to the circumstances and applicable law.

BusyTap remains responsible for obligations that Malaysian law places directly upon BusyTap and that cannot lawfully be excluded.

26. Indemnity

To the extent permitted by law, a user may be responsible for losses, claims, liabilities or reasonable costs arising from their unlawful use of the Platform, material breach of these Terms, infringement of third-party rights, or misconduct.

Any such responsibility will be determined in accordance with applicable law and the relevant circumstances.

27. Changes to These Terms

BusyTap may update these Terms to reflect changes to:

* Platform functionality;
* Services;
* Business operations;
* Legal or regulatory requirements; or
* Marketplace policies.

Where material changes affect users’ rights or obligations, BusyTap may provide appropriate notice before the updated Terms take effect where required.

Continued use after the effective date of updated Terms may constitute acceptance where legally permissible.

28. Governing Law

These Terms are governed by the laws of Malaysia.

Any dispute relating to these Terms or use of BusyTap will be handled in accordance with applicable Malaysian law and the jurisdiction of the competent Malaysian courts, subject to any mandatory consumer dispute-resolution rights.

30. Acceptance

By creating a BusyTap account, making or accepting a booking, or otherwise using the Platform, you confirm that you have read and understood these Terms & Conditions and agree to be bound by them, subject to applicable law.
